TERMS & CONDITIONS
These Terms & Conditions apply to all services provided by Ember Advertising & Media (“we”, “us”, “our”). By engaging our services, you (“the client”) agree to the following terms.
1. Services
We provide marketing, media, design, print and related services as agreed in writing. Any additional work outside the agreed scope may be subject to additional fees.
2. Payments
All invoices must be paid within the stated payment terms. We reserve the right to pause or withhold work if payment is overdue.
Where applicable, ongoing services are billed monthly in advance and are non-refundable once the billing period has started.
3. Revisions & Approvals
Reasonable revisions are included where agreed. Excessive or out-of-scope changes may incur additional charges.
It is the client’s responsibility to review and approve all work before final use. Once approved, we are not liable for any errors, including spelling, pricing, or content inaccuracies.
4. Print Disclaimer
All print files must be approved in their final form before production. Screenshots are not accepted as final artwork.
We are not responsible for errors once artwork has been approved. Colour variations may occur between screens and printed materials, and exact colour matching is not guaranteed.
5. Turnaround Times
Any timelines provided are estimates and may vary depending on project scope, client response times, and external factors. We are not liable for delays caused by third parties or late client feedback.
6. Content & Media
We may capture photo, video, and audio content as part of our services. By engaging us, the client grants permission for this content to be used for marketing, portfolio, and promotional purposes unless agreed otherwise in writing.
7. Intellectual Property
Final deliverables may be used by the client once full payment has been received.
Unless otherwise agreed, we retain ownership of all working files, raw content, and project assets. These are not included unless specifically purchased or agreed in writing.
8. Third-Party Costs
Any third-party costs (e.g. advertising spend, printing, domain names, hosting, software subscriptions) are not included unless stated and must be covered by the client.
9. Cancellations
Ongoing services may be cancelled with written notice as agreed (one week before the next billing period).
Any work already completed or scheduled will be charged accordingly.
10. Liability
We are not liable for any indirect, incidental, or consequential losses, including loss of revenue, bookings, or business.
Our total liability is limited to the value of the services provided.
11. Client Responsibilities
The client agrees to provide accurate information, timely feedback, and any required materials to allow us to deliver services effectively.
12. Changes to Terms
We reserve the right to update these Terms & Conditions at any time. Continued use of our services constitutes acceptance of any updates.
13. Governing Law
These terms are governed by the laws of the United Kingdom.
